    What is the course like and do you have to take a test after it? Thanks

    We took our credit counseling online. We provided our social security numbers and needed our monthly expenses. Our credit report showed up online during the counseling and we just answered a bunch of questions, kind of like a survey. Every few pages a live online person would check in to see if you had questions or needed help. You just have to respond to them, so they see you are actually doing the survey. Easy Peasy. At the end there was a certificate to print out. Good Luck.

      It's sort of absurd to require credit counseling before filing for BK, since the decision to file has most likely been made and is not likely to change. But it would have a tendency to flush out fraudulent filers by making them aware of their overall financial picture.

      I had my pre-filing counseling session by phone (Credit Card Counseling Services of New Jersey). You must provide information on all of your debt and all of your income. Then the counselor suggests ways to budget and live within your means and offers a plan to pay off your debt outside of bankruptcy.

      CCCSNJ was very up-front about their way of doing business (which is probably not a lot different than any other court-authorized credit counseling entity). They are a non-profit organization which derives a significant portion of it's income from the larger banks, which pay a commission when debtors accept a repayment plan proposed by the agency.

      I could not afford the proposal they offered me! The monthly payments were higher than the minimum payments I was making on my credit cards for the privilege of staying in debt until the day I die.

      You (the debtor) are under no obligation to accept the proposal offered by the counseling agency - your only obligation is to listen to it and have it documented that you did so, and provide proof to the Trustee htat you did so.

        We went to Consumer Credit Counseling before we even thought about filing bankruptcy and the credit counselor actually recommended we file. And then told us that the pre-bankruptcy certification session could be done in a 5 minute phone call. But they did send us a book to read and some paperwork to fill out. This company charges $50 per person to do the certification.

        We are going to try to get a waiver for that fee though.

          The class is a farce. I would put money on it that someone who helped write the new law had a stake in a company that provides this service ( for a fee of course ).
