ch 13 to ch 7 conversion timeframe

    ch 13 to ch 7 conversion timeframe

    Is their a specific time that you can convert ch 13 to ch 7? It seems like when I read about others who have done this that it happened early in their ch 13. Can you convert any time during the course of the 60 months? I am only in month 4, but my job may change in about a year and I will make less money and that will allow me to qualify for ch 7. Thanks, Katie

    No, there's no specific time. Your lawyer can convert your 13 to Ch 7 anytime you qualify for Ch 7.

    Do keep in mind that it may cost you more than you've already paid your Ch 13 lawyer to convert your case to Ch 7, so talk with your lawyer about the possibility and find out if this will be the case.

    01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

      Just my experience:

      July 2006 filed Ch13: on an unconfirmed plan I was sending the trustee $250 a month

      Oct/Nov 2006 converted to Ch7 (my lawyer said I didn't owe him another penny) originally I was due to pay him $3000 ($1000 would be paid through Ch13). The day I told him I was going to quit one of my jobs so I could convert - it seemed to happen overnight - I called the trustee assistant and she received the conversion notice and said I didn't have to pay them another cent - in fact I made total of 3 payments and got my money back (accept for like $75 which the Trustee kept as admin fees!)

      Jan 2007 DISCHARGED !

        So, if we file a Ch. 13 right now and don't qualify to file ch. 7 again until August of this year, would we be able to convert to a chapter 7 after the anniversary date of our original Ch. 7 filing in August 2000? Would that 7 be dischargeable?
