        Thank you and thank you to everyone for your help and advice. I am searching for a new attorney since he didn't call back. Not that I expected him to. I am sure when I report him he won't represent us anymore.

          You should officially sever the relationship in writing, because other lawyers are unlikely to even see you unless you can prove you fired your original lawyer.

          If I were you, I would also request a refund of your retainer fees as well (although it won't surprise me if you don't get it back - but it never hurts to ask!)

            Thank you I appreciate the information and help. Do you know is it possible to get all of my fees back? I just checked and they have already paid him all of his fees in addition to the retainer.

              Ok if anyone at all has a suggestion I am up for it. I have called every bankruptcy attorney within 50 miles of our house and no one is willing to take a case from the attorney we have eventhough they know we are going to fire him. They all say he is the biggest firm around and they don't want to mess with that.

              Can I do this myself?

              I know as soon as I call the State Bar and Attorney General's office I will not have any luck with keeping him as an attorney.

                When I switched attorney's, the new one I hired told me that 1 letter from the ethics committee from the state bar could ruin an attorney's entire year. LOL He was suggesting that I report my attorney to the state bar. Your other resource is to go to the office and wait to see him. And if he refuses, then you can deliver your fired letter in person. If your case is already confirmed and you are making payments, you may be ok from here on out. Just be sure you stay in contact with the trustee and let them know you are now "pro se". GL

                  Thank you but what do we do about the fact that we are behind and eventhough the judge ordered a payment schedule or attorney went a signed a stipulation with the mortgage company and if we aren't caught up by the end of April it says they are allowed to forclose.

                  Sorry to keep asking questions I just don't know where else to go and I want to make sure everything is covered.
