    Does this sound right?

    We met with our attorney yesterday to sign the paperwork to voluntarily dismiss our 13. We are going to wait 6 months and refile, but as a 7.

    Anyway, one of the things we want to do is surrender one of our vehicles, the one we are totally "upside down" on and the largest payment. Our atty has stated that we should stop making the payments on the vehicle around June or July (we will file 7 in October). He said even though we would not have the payment on our means test, we will still pass the means with all of our other bills (high student loan debt).

    But this doesn't seem right to me - stop paying on the vehicle? They will repossess, right? That's basically what he's saying - let them repossess it instead of waiting and surrendering it.

    Anyone have any advice on this? I personally think we should keep paying and just surrender it, but if it's not going to negatively effect us, we sure could use that extra $$ per month.

    I think what the lawyer is saying is, you are going to lose the vehicle anyway. Why waste the money on it? If you time it right, you can save a couple of dollars and put that towards another vehicle after discharge. Also if you time it right, the repossession just may occur around the same time that you would be surrendering the vehicle.
