    New Job with substantial pay increase

    Greetings...newbie to the forum

    My plan was confirmed on 2/17/08 and 2 weeks ago I was unexpectedly offered a new position with a $31,000.00 pay increase. I live in upstate NY.

    I reviewed my plan and all information from the trustee. My plan calls for reporting to the Trustee "]"any funds recieved greater than $2500.00, other than monthly income."[/I have written to my trustee and my attorney requesting a new wage order be sent to my new employer so that my bi-weekly payments of $504.00 continue uninterrupted.

    Will this unexpected salary increase affect my plan and payments? Plan calls for 100% to unsecured claims. Thanks for your feedback!

    Since your plan is at 100% probably not; but always consult with your attorney when there is anything majorly financial taking place during your Plan.

      Sent a letter to my lawyer notifying him of my new employer and requesting a new wage order be sent so that plan payments can continue un-interrupted........Got a letter back from him stating I have to send him my first months worth of paystubs from the new job and he will have to notify the trustee if my income has risen more than 10% than was stated in the original plan...........

      Due to health and transportation issues my wife will be going from full time to part time employment with an associated drop in income that will reduce total family income ....essentially my raise will offset her income loss......will the trustee take this into consideration when it comes to a possibility of increasing plan payments? 60 month plan 100% to unsecured...wife did not file

        Since it appears your filing is not joint, your wife's income is not a part of the income for your own plan unless it is indicated in there otherwise. In any event, consult with your attorney before providing any documents.

          Even though your wife did not file, the portion of her income that she contributed to the household was included in your income calculations when you filed. Your lawyer needs to notify the trustee about her change in income status as well as your own because the amount she contributes to the household is changing as well.

          Does your lawyer intend to file an amended plan? If he does, then your wife's reduced income can be reflected in the revised B22C forms and Schedules.

            No mention of amending the plan by the Lawyer....states he needs to notify the trustee of any income increase over 10% which it will be! A previous poster stated that I may be OK in that my plan calls for 100% to unsecured.
