    Rent Change During Ch 13

    I know we are required to send new address to attorney for trustee if we move. I know we can move during a Ch 13.
    We will be moving to another state this summer. Our payments were based on budget with rent being $1750... and our new rent will be about half that amount..

    So does anyone know or have experience that once you send in new address, trustee could ask for what your new rent is and make payment changes?

    It is certainly possible, but probably not (unless the trustee has specifically instructed you to let him know about significant changes in expenses). Trustees don't really tinker around with confirmed plans. They may look for additional income (i.e. tax refunds), or signicant increases in employment income as reflected on your tax return, but they do not typically audit your expenses.

    Thus, I would not worry about, but you should call your attorney and get their take.

      When we filed our change of address (6 months post confirmation) they wanted to know what we were going to be paying (rent). Our 'new' rent was less than we had been paying so our C13 payment raised by the amount we hoped we were going to be saving. Didn't work out the way we had hoped.

      So, it can happen.

        wow 1750 for rent? what state is that?

        We're moving in the summer and our rent will be going to double the amount. What do I do in this case?

          my rent is exactly 1750 too! Small two bedroom in southern CA

            Wow............Things are sure different over there on the West Coast.
            My mortgage, property taxes, and insurance are only $1019/mo combined. 2 bed house on 1.1 acres.

            Ouch!!!!

              We are in GA with a family of 5. The irs standards were $1493 for rent, however we could not find anything for that amount in this school district. I was a realtor at the time and pulled listings to prove that what I was paying was average. Trustee balked but eventually agreed. (Even though the food/clothing/internet/ budget was cut to basically make up the difference)

              Asked attorney the question if trustee will ask for new rent. She of course can not guarantee anything, but said he usually doesn't ask. So I guess it will be wait and see. It would be nice to be able to save the difference.
