Hey Wildfamily5.. can i ask what your income was ? over median? how far under.how many people in your family?

I just bought a new car with lower loan, means lower payments. I just gave back my other car to credit union. I have a credit card too so i will file on it now after giving back card. Credit unions suck.

Family of 5, income was $40K/yr. Under median, that is why it is 3 years instead of 5, from what I have read. I don't live in a big city so things are cheaper, buying a house is only about $50-$100K around here.

Anyway, could have tried to give back car and gotten a new one but credit was already shot of course. One thing I didn't know until later is that putting the car in the plan automatically puts the APR on the car to 10% interest. Could have maybe found a car, even with bad credit, for 10% apr. I guess that is something to think about.

yea i talked with my attorney. i was surprised when she told me i could give back the car and find another one more reasonable in price. I was even more shocked to find out i was approved with GM for a 3.9 intrest rate and lowered my payments $300!!!! I was only behind 1.5 months on just 2 cards. Now the card i still have with the same credit union will go back as well.

Im under median too. My attorney said this state is 6k a month and im under by about $1100 with family of five. Praying for 3 years with no objections. Im only doing 13 so i can refinance my house before the arm kicks in. According to my market analysis ive got almost 7K equity already its only been 1.5 years..

Mine was going to be $250. Until the Trustee got greedy and wanted $800. I don't think there is an "average." There's alot of factors involved depending on assets, type of income vs. expense. How many mouths you have to feed, etc.

I'm sorry IRPRN, I didn't mean to come across that way, whatsoever.
I apologize to Wild as well

It's much more welcoming to a new member who's made their first post if you would ask these kinds of personal questions a little more politely. For example, you could have said "Do you mind sharing some background about how you decided to file?" You'll get the same information without the need for multiple question marks and you won't put a new member on the defensive right off the bat. Thanks for considering.

1100 a month out of like 5030 bring home after taxes ,car payment and unsecured at like 30% are in plan. Not bad considering we were paying like 2000 to unsecured and getting no where close to out of debt. We used a settlement company for a year all that got us was about 28,000 or so deeper in debt

sanra 308 you bring in still 5030 a month!! after you pay all that?? so that means you still have 3900 a month of disposable income? or was that supposed to be a period instead of a comma.

We're at $393 a month, which includes an auto cramdown--somewhere around 9% payback on unsecured (the only secured is the auto). Quite a bit above median income. Dollar amount is courtesy of a most excellent attorney.

                      .

We are paying 120 a month for 3 years. That is I believe the lowest you can pay. They also go by your income. Not just the amount of debt you owe.

We retained our lawyer and didn't file Ch 13 until five months later. We didn't use our credit cards or make any preferential payments during that time to ensure we had no trouble in those areas.
This is what I want to do. I want retain an attorney and wait to file. Will retaining an attorney keep the creditors from contacting you?

We retained our attorney in December at which time he advised us to give each creditor who called his name and number, and to say nothing further. We did as he instructed and by the middle of January had the last of our phone calls.

                          We filed in July.
