    have a ? about filed claims

    i filed bk in sept 07 had my 341 meeting nov 7 and confirmed nov 7. The final date for people to file claims was feb 5. There were only 8 claims filed.
    I am at a 100% payback plan. My total payback is $54,000. The total of the claims filed is $12,000.
    okay my question is do I have to pay the whole $54,000 or do I have to pay the amount that was filed? Any help would be great. thanks

    if only $12000 worth of claims are truly all that have claimed then that would be all you would have to pay. we thought only a few had claimed but in reality there were more they just were'nt all listed on pacer yet. Good luck I'll keep my fingers crossed for you.

      From what I read on a previous thread, you must pay all of what you said your disposable income is but they will simply reduce the number of months you will be in payback. I'm sure someone else will respond also.

        In Ch 13 you pay back only the creditors that file claims within the allowed time period. In your case if you are certain that all the claims have been entered into PACER (do keep checking for the next few days - there could be a few late entries), then you will pay back only the $12,000.

        Your monthly Ch 13 payment will remain what it is as if you were paying off the $54,000, but once the $12,000 is paid in full, your plan will be done and your case will be discharged....woohoo!!
