    Scared! so many questions

    I had an initial consultation with a bk atty in Oct of '06, paid him a small retainer a couple months later and haven't been able to pay a dime since then towards my case. Husband was laid off twice in '07 and spent at least half the year unemployed. My salary took a nice jump in '07 so I fear that may take me from Chp 7 to Chp 13, plus found out hubby didn't file taxes one year, so now I'm SO worried about my case.

    Does the means test take into account money/prior monthly pmts owed on repo'ed cars? We live within our means now but only because our cars were repo'ed.

    AND I may be taking a better but lower-paying job in the next few months. Is it possible that chp 13 monthly pmts could end up being too high for us at that point?

    Ahhh, I'm so scared about all of this!

    I would try for a ch 7 if it were me. If you pass the means test (salary for the last six months) then by all means that is the right thing to do. You are currently still struggling, being in a ch 13 and missing payments will get your case dismissed.

    Is there a reason other than DH being laid off as to why you not able to pay the lawyer? Have you stopped paying the CC's?

    Talk to a lawyer about the taxes. Not filing is serious and can get you into trouble. You need to show the last two years filings when you file for BK.

      Yes it can & I'm seriously hoping that the refunds he was due those couple/few years will somewhat offset IRS penalties.
