Credit cards on chapter 13

How does this work we are no huge rush to file yet sicne we just started to get behind my question is how is filing with credit cards on chap 13 do you need to be 90 days since your last time using your cards??? With christmas coming I am sure they will be in use!

I am pretty sure we will be on a 100% payback from the numbers I have come up with! Let me know your thoughts!

Typically one should give time between using cc's and filing (90 days). Once you file DEFINITELY don't use the cc's that could be a means for dismissal - (but I could be wrong about the dismissal part). You are not allowed to take on new debt once you file (especially for ch13). Just save all your receipts in case you need them when you file. Before I filed, I had considered one of the debt mgmt programs, I ran up my credit cards just before I signed their paperwork stating I shouldn't use my cc's. Eventually down the road before I let myself totally get ripped of by the program I ended up filing Bk.

The information my atty. gave me was they do not want to see any activity on the cards the prior 90 days before filing .We had a few charges for food and gas(very few and not near the 90 day mark) but he said that using the cards to live is one thing but definitely any charges for anything else,like Christmas gifts, would not be acceptable. Gifts are a discretionary expense not a necessary expense.
