    Cell Phone Transfer before filling

I am filing Chapter 13 next week. I am really upset at some of the customer service and service that Verizon is currently providing me. I would like to change to ATT however I have almost 2 years left on my contract and they will tack probably 200 (600 total) a phone for early termination. Can I call them and tell the to cancel my service and then get service with someone else and include the Verizon bill as a debt my Bankruptcy.

Any help would be appreciated! I e-mailed my lawyer but being a Friday she will not get back to me till next week and I am filing next week.

Don't think you'll be able to because your Verizon bill/and the early ternination amount have not yet been billed, and as of now are not yet delinquent. Ask your lawyer to delay the filing by a month, cancel Verizon, wait for the early termination bill to arrive and then have that bill included in your filing.

I know this is from last week but, I filed Ch. 7 and we cancelled our Verizon and ported our # just days before filing and were were able to add this to our BK as our attorney states, the Early Termination Fee is Effective the date the # was ported, not the date it was billed. We just filed 2 weeks ago too though, so I haven't had any problems with that YET.

        Cell Phone Transfer

Thanks for all the replies. Just for informative reasons my attorney did say we are allowed to do that and could do it days before the filing. They would just put th eamount down that it is expected to be and when verizon states there claim they will get the exact amount. I however am going to stick with Verizon as I researched all the other providers and verizon seems like the best one out there that I can currently get. ATT wanted me to pay a 750 deposit per phone (HA).

I don't know where you are but if you have Cricket available in your area you ought to check it out. Hubby and I have been with them for almost a year now. We have great service. We pay $103 a month (that includes taxes). We have unlimited min to anywhere in the country anytime. It doesn't matter if it is to a land-line or cell phone. And it could be 3p on a Monday and it is still no charge. And if you can't pay your bill one month you don't. You just don't have service for that month (I can't remember when everyone didn't have cells). I like Cricket much more than I did Sprint or T-Mobile.

I have 4 lines on sprint
              2500 shared anytime minutes 125.00
              free 6pm nights/weekends
free sprint to sprint text and voice

line1 treo 650 free power vision (includes free internet, pictures, texts, tv, all the extras, emails)
line2 treo 655 6.50 power vision(includes above same except text) 6.50 unlimited texts
              line3 no charge kantan
line 4 no charge no phone attached

I also pay 6.50X2 replacement insurance on the two treos.

So total I pay 147 plus tax minus 10% loyalty discount plus 20% empployer discount
              Final Amount = approx. 110.92
This is after being with sprint for 5 years and widdling them down each time I need to renew! I have negotiated away the fee on each phone and I've just got the one vision/picture fee left on line 2 to negotiate on the round next year and I think I'll have it all for free except the main fee!!!! I was paying over 220 per month for the same exact plan 2 years ago. You just have to play them right!

This is what you do. Just before you are eligible for an upgrade it also means you are going to need to renew your contract. We once you upgrade they make you renew. So once you do that they you have no power. So if you call in and don't mention upgrading. Just ask for the cancellation department. Tell them you have been looking at the other companies and wanted to see what the process is when you get ready to cancel because you are going to be out of town and need to leave insructions with your husband to call and cancel the acct for you. Then they will start the negotiation. Do you homework though. You need some talking points on what is good about the other companies. Maybe they offer free unliminted text messages. Whatever you can think of. Maybe their service is just plain cheaper. You tell them what you need. What I told them is that I loved my service EXACTLY like it is and if I staying I didn't want to change anything but the price and I need to cut the price at least in half. Well, she did it. She applied this discout that discount, removed this charge, poof that charge was gone, found a zero charge code for that one and oh, look I can get you this one for free too. And what do you know. WE were at half the price in less than 15 minutes! Go figure! I've gotten a little off each time but this was my most successful ever! My next target is the cable company. WISH ME LUCK!!!!!

I know cell phones are pretty much a way of life these days. Does the bk trustee see it this way or as a luxury item?

you can call anywhere. they have a plan that you can use if you travel a lot, I think it is $5 a month more. It is worth checking out their site at mycricket.com . I hope I am allowed to post that. Anyway, we are happy with them. The only problem I have with them is that I don't get good reception in my home. In my work building I get a great signal. I like not having to count minutes. My dh is always on the phone with his friend and his family. We use to always be over with the other carriers. It didn't matter how many minutes we had in our plan. I forgot, we also have unlimited messaging.(not that we ever use it.)

Our trustee didn't even mention our cell phones. The only thing she had an issue with was dh spending nearly $90 a month on tobacco. She said we were at 100% payback in 40 months though so she was not going to be real picky.
