    Amending!

    Does anyone know how much it would be to amend a plan? I forgot about a credit card but it's HSBC and I've got HSBC listing already but just a different account. Is it necessary to tell attorney about that specific account or will the bank get the letter and include all my accounts under it?

    I'm not positive, but somewhere I have it in my head that it's $124??? Although I suppose it could vary from place to place, but for some reason I am thinking it's a little over a hundred bucks.

    Plan Modified July 8, 2009 from $1100/month to $400/month due to change in income, finally discharged in July of 2013!

      The filing is only about $26, however your lawyer may charge more for the work they have to do on the amendment.

        yep, I'd pay the $26 to have it added. Otherwise HSB could possibly just close the 2nd acct. and try to make you pay for it.

          Hmmmm...if you have HSBC listed as a creditor already then they should be filing a claim for any amount that you owe them. I'm not sure you will actually have to add them again for the additional account. You can ask your attorney to be sure, but I think you will be fine.

            Cindy makes a good point. You've already listed HSBC. Chances are, if they file a Claim, they'll file for any and all accts you have with them.

            A lot might depend on your attny. How thorough he/she feels they need to be. Definitely let your attny know you left off an acct with an already named Creditor. See what your attny recommends.

              My lawyer charges 250.00 for any extra services, I just paid him 250.00 for him to amend our plan, because our pay went up alot but we have added expences so it evens out, in all I have paid him an extra 750.00 for 3 services since I filed April of 2006.

                A good way to know if they have captured the forgotten account is if your still getting bills from them. If they quit sending a bill, they got the message!! If they send you a bill, you can always send a copy of the bk notice (you should receive a copy of it when the court sends it to the creditors) to the address on the statement (not the payment address, look on the back of the statement for the business address).

                I actually sent a copy to a creditor I forgot and have never heard a peep out of them since. Send it certified so you can prove you sent it to them.

                  So, even though that actual account number is not in our list of creditors, but the creditor is, we should be ok?
                  My attorney wants $80 for an amendment. I'm hoping we can avoid that.

                    Your attorney should be able to advise you on this. It was my understanding that as long as the SS# is correct, the creditor should be considered "notified". If your unsure, call the creditor and ask them if they received notification...sounds kinda ballsey, but what the hell.

                    Face it, most people who just filed Chapter 13 and haven't even made there first payment yet are kinda strapped. If $80 for the amendement will give you a greater piece of mind, it might be worth a sacrifice in other places.
