Do most people on the board still have a debit card that they can use? Or, do we have to give that up too? Also, can you choose to pay your payments directly to the trustee or do you have to have them payroll deducted...just wondering? Thanks for the info.

Your debit card shouldn't be affected, it is not considered a line of credit. Whether you required to pay via payroll dedcution is up to your trustee/district rules and exceptions can still be made for different circumstances even if there are rules to that effect in your district.Chapter 7 Pro Se....Discharged Feb. 2006

My debit card was frozen, but you can not go by my situation. I had the loan and credit card and Visa debit card with the credit union where I worked. I had payroll deductions for the payment on the credit card and the loan with the credit union. The Visa debit card was a perk. However, once I filed against them, they froze everything. Talk about upset, I could not get money on payday, I did not have new checks to write for cash, I could not charge anything and they would not pay anything out of my savings account and froze the money as well. I went through hell and back trying to survive without any way of getting my money from them. Then all of a sudden I received a letter stating that my services would all be activated as long as I signed an agreement to allow the credit union to keep deduction my payments via payroll deduction. Since they never stopped anyway..even with the automatic stay, I signed and everything was activated again. They did a number on me.

Let 6ft's story be a lesson to anyone out there who has not filed yet. Make sure you have a bank account and an atm/debit card at a bank where you are not BK'ing ANYTHING, or that kind of thing can happen.
I think the debit cards are a wonderful thing. Never ever used them before the bk, was always credit cards all the time. But when you pay the bill at a restaurant, looks just like a credit card and helps ease the pain of not using credit during the months leading up to the filing and during the bk as well.
I suppose in the old days, was only 3 ways to pay during a bk. Cash, checks and money orders. Glad we have another option now.Filed Business Chapter 7: 7/11/07

If your trustee only accepts payroll deduction but you have extenuating circumstances, your lawyer can ask the trustee to accept a different payment method. In very unusual circumstances, the court can enforce the trustee accepting a different payment method if it comes down to that.I am not a lawyer and this is not legal advice nor a statement of the law - only a lawyer can provide those.
