MajorMike, the Median proved I was negative disposable income (-$60). However, schedules I and J showed I had $800 actual disposable income. Testing the "new laws," my lawyer bet on suggesting a "good faith," plan to pay the creditors back $250 a month (because of the Median Test), due to having 2 full time jobs (thats where the income came into play). At $250 the creditors would have gotten .13cents a month over the course of 5 years, however the Trustee didn't like it and wanted my extra income. When we went to the judge, he told me the law does not require you to work 2 full time jobs, so if you quit one job you could convert to Ch7 and pay nothing. If you choose to work 2 full time jobs EXPECT to pay back $800, you have 15 days to submit another plan. Well it wasn't too hard to figure out, quit one job and pay nothing and lie low for a couple months OR be in Ch13 hell for 5 years working 80 hours a week and not 40.

      Best of luck you! Catchmeifyoucan
