We're about to get our plan confirmed this month and everything is going good. But....
My husbands dad died about 10 years ago. He owned a small piece of property that is not big enough to put anything owned. It was across the street from his house he used to have. After he died, the property just sat there. We never thought of it again.
Well some people had built a house adjacent to this piece and would like to buy it to make their yard bigger. (I've just learned all this) And my husband, his sister, and brother are on the deed. He had no idea he was on that deed. We never even thought of this property. It's not worth very much. The people want to buy it for $3k. We just got an envelope in the mail from the closing attorney of the property to sign a warrenty deed to these buyers. As I said, didn't know my husband would even be involved in this.
I called my attorney immidiately (no answer, left message)after getting this because we can't sell or convey anything. I'm concerned that it will look like we were hiding this or lying on our Statement of Affairs or in the 341. That is not the case at all.
So do you think this will be ok? I mean the trustee would have to agree to sell, he'd want to keep the $1000 my husband would get..fine. I just don't want anyone to think we left this out on purpose.
