Ok we went to our Lawyer on Thursday. Spoke with the paralegal to get all paper work in and paid $400.00. We filed to stop our house from being foreclosed on. She was backed up and said she would need another appointment because the copy machine took FOREVER. We had everything even the ccs papers and ALL else. Our ONLY secure debt other than the house was a rental company. She told us to hold them off till she gets a bk#. But they keep knocking at our door and honking the horn so we can get embarrassed with our neighbors. We have 2 days to go can they get the cops involved if they said they want to pick up the merchandise. By the way we noticed today, when we signed the paper work on Oct 7, 2006 on the lease agreement the manager signed it but not us. we gave it to the lawyer. Does that even matter? We officially never signed the papers on the lease? But regardless can they get the police to visit us or is it a civil matter? ANY help would be very helpful because tomorrow is Monday and the knocking will be again and again and again.

If they are knocking on your door they are trespassing YOUR property. You call the police and ask them to leave YOUR property or you will call the police. Put a not on your door that says anyone that says "Please do not knock or ring door bell. Police will be call Immediately. does anyone know if a lease is not signed and a year later you notice "Is it still valid"??
It was mistakingly not signed, but the manager Did sign it , Just we did not "Is it valid?"
This is a rental furniture and we barely noticed we never signed the agreement when we went over paper work for the laywer. Any help will be thankful.

Arguement #1 : The lease is not valid. Then you should not have the furniture. Then you should answer the door and give it back.
Arguement #2 : The lease is valid. then you should tell the people to leave our property, call the police, have them arrested for trespassing and include the furniture in your bk.
If you want to keep the furniture you actually NEED the lease to be valid. If the lease is not valid then you need to give the furniture back pronto b/c that means you have no right to have it.
In most states, having accepted delivery of furniture on your part and them having accepting the payment on their part constituted execution of the agreement whether it was signed.Chapter 7 Pro Se....Discharged Feb. 2006

call 911! they have to leave unless they have a repo warrant!!!! PERIOD. THE END!!!! Or just choose to ignore them for one more day. They can't break in. You can do it!!!!!!!!! You will eventually have to involve the police, but it may be better to wait until you have your case number in hand as you ammunition!!!! You are strong you can do it!! fight fight fight!!! I'd give the damn table back and sleep at night. It's only $1300, not thd end of the world.
I'd kill my g/f if she bought a table over $500 anyway! LOL
It's not like you won't be able to ever get a table again. Just get one that's less expensive until you can afford another one.
There is no way I'd let $1300 cause me the stress like that!!!

No, no, no. Don't give anything back. Get your lawyer to submit what they call a "skeletal filing". Just the basic information with a list of creditors. Make sure you have all of this and make sure she files on Friday and gets you a bk #.
Then as soon as you have that, tell the creditor this so they back off (don't tell them you are about to file, as that will make them even more aggressive). But they simply CANNOT go into your house without a judgment to do so. Fill out a police report for harrassment so it is on the record in case they resort to stealing it.Filed Business Chapter 7: 7/11/07
