    I think that the suggestion to ask the trustee to skip a payment or two is the best option. I have heard of that happening more than once and car repairs is a valid reason!!! I would certainly move on that option ASAP!!!!

    And PEOPLE, stop the JUDGEMENTday crap!! Everyone's situation is different. Even if the factors seem similiar you CANNOT compare. Offer advice and do not compare and judge!!!! Stop the madness!!

      I couldn't have said it better myself. Everyone needs to take a step back and stop. For us 13er's, we are between a rock and a hard place. Statistically, we are going to hit rough spots during our plan and we need all of the support that we can get.

        I pray that your trustee is more..um.....responsive than mine has been. And best of luck getting the repairs done. If I lived around there I'd do the labor for you to help out. And I mean it, I really would.

          and i thank you for saying that, it means alot. No i'll contact my lawyer.....and see what can be done, but i was going over the repair orders since I take this thing to the dealer ...i have it documented, do you know we bought this thing in 9/00 and 10/00 it started with the suspension problems, in the very first full 30 days of having it? sheesh.

          I've contacted ford directly..........i want to see what can be done about this, this Is NOT right!

            I'm going into a 13 to consolidate and start widdling down this debt. I have varied income, meaning, one week I'll make 1100 and the next 4500. It varies. The last 6 months have been bad but I have to file before I get paid on a $6,000 commission I just sold. This is why 13 will be ok for me. They take the avg. of the last 6 months to configure the payment. My attorney said our trustee doesn't ask for bank statements or tax returns at all during the 5 year term. I'll be ok, because I can just make more if I have to and still afford the payments. ( or I can work another job )
            I understand it must be hard to be sick and stressed at the same time and I apologize for stressing you out. I wish I could help. What about the 722 plan thing? They DO have something for Chapter 13 filers. I don't know the details but it looked pretty good. Also, regarding my warranty, I took it out way before I decided I was going to file. Last year I won $50K at a casino and I was debt free. It didn't take long, but unlike most on this forum, I'm not broke. I just want to pay these things off and move on. I also owe the IRS and with all the interest and penalties, I'm not going anywhere.
            I know there may be other forums online with "angels" that help people in need and you don't have to pay anything. Where there is a will, there is a way. I know God will help you. How much to fix the car, by the way. ( in case an Angel needs to know )

            are you actually IN any kind of bankruptcy. are you in a 7 or a 13.............

            if not then you need to understand that people are BROKE in a 7 or a 13.........esp a 13

              Wooisme, when I had to spend 800 on car repair I missed 1 payment to the trustee (2 gets it dismissed) and let my lawyer know about it. His response, get it caught up as quickly as you can (have been adding 100.00 each month to next payments made on time) and then he told me to save my receipts to show the trustee the repair bills and then the lawyer was going to ask the trustee to let me keep any refunds to pay me back for the car repair. Hopefully your lawyer will be as helpful.

                the cost to replace a rear suspension including parts and labor I am looking at $1,000.

                the last time this happened, two years ago, they did a 50/50 split because the car was out of warranty by a few months and because my brother works for ford and called them up to say, hey you can PO5 IT! and they did. so at that time it costed us $525 so that was 50%.

                Replacing a rear suspension , a rear air suspension is NOT cheap. But I did some investigating here on my end of things and we started having trouble with this thing less than 30 days after buy this NEW with the suspension problems. Now my neighbor has the exact same SUV and has never had to do a thing to the suspension. this car is a lemon but more than likely exceeds the timing of getting a lawyer involved in a lemon law but i can prove with the repair orders it started 30 days after we purchased it. we have ALLLL the repair orders on this gem!

                  Is it an Escape? I have an Escape and my boyfriend said it's known for it's rear end suspension problems. This is another reason I took out the warranty. He said you better or you'll be sorry.
                  Its a 2005 Limited but not one problem ( yet ) so I am crossing my fingers.

                    no this is a 2000 lincoln navigator. and it doesn't matter if we did or didn't take it out, it's all water over the bridge. i don't need to be scolded again by saying you better take out a warranty or you will be sorry.

                      wooisme, I feel for you. We had the front suspension go out on our 2002 ford taurus about 4 months ago. It really killed us financially. It was close to $600 and we had to piece things together for a while. Call your lawyer and have him ask the trustee to miss a payment and add it on to the back end. After all, your husband needs a car to get to work. Keep your head up. Ch 13's are challenging. Just wanted to let you know, that I feel your pain. We have gone through broken wash machine, car repairs and roof leaks, but somehow we have been able to pull through. Good luck.

                        Sounds like your vehicle might fall under the Lemon Law if the problem is the same all those times. Lemon law problems need to be safety issues like brakes and suspensions not cigarette lighters that don't work Talk to your dealership and contact a ford arbitrator if it is the same issue again. My hubby had a ford truck that he had to get a full drum to drum because there was something wrong they could not fix. He had to wait for the factory rep to come look at it but it got resolved. I've had a few Fords, One mustang and one focus both brand new and so many problems I got rid of both of them within a year. My husband is a auto technician so we are lucky. Oh and one other idea is to get one of those news guys involved. Our local channels have a reporter that looks into consumer problems and they just love car repair issues. GOOD LUCK! hopefully your trustee will be understanding!

                          I'm not sure if you posted "who" is doing the repair work but if you can't get Ford to acknowledge the problems and you decide to fix it, you may be able to get a discount. We went through a 7 not a 13 but right after we filed our minivan needed about $1500 worth of repairs (surprise). We took it to the dealership to be fixed and after a little negotiation, they gave us a discount on both parts and labor which ended up saving us a few hundred dollars. It's not much but it may help if you have to skip a payment to get the repairs done.

                          I wish you much luck on getting this resolved!!!!

                            As far as the Lemon Law goes, I'd definitely check into that. A navigator is an awesome vehicle and very expensive. It shouldn't break down like that!!!

                              Just curious, what year is the SUV? How many miles? My parent's SUV had some issues after the warranty was over and the dealership honored it anyway with a little pushing of the issue! Also, you mention this is the third time for this same part. This part may still be under warranty. I had an air conditioner replaced in a very old car that kept going out for a year and they kept replacing it for a year! don't give up! Keep pushing this issue!

                                It's a 2000, and it's not the same part but the same thing, meaning, it's always the suspension.......we got this thing new 9/00 then 10/00 it started with the problems then 7/03 it had suspension problems again, then 08/05 it happened again and now 8/07 it's happened again. but it happens every two years or so since we bought it new ...it's always the rear suspension and i know people that have navigators and they do NOT have these problems.

                                I would have just turned the damn thing in but it's a part of the plan now and we owed more than it was worth so couldn't sell it........but was crammed down to what it's worth in the plan..........besides he needed something to drive anyway, and we couldn't get financing to buy another with credit problems. besides, it's handy when driving out of state to see relatives and traveling with three dogs.

                                I've contacted Ford. i should hear from them in two business days, i'll talk to the dealership on monday.............this thing will need to be towed, can't drive it but we have the southern hospitality program and it's free towing for the life time of the vehicle.......but i need to know exactly what we are looking at here with what it would cost.........i just can't have it towed there if i can't afford to pay it. so i will be really busy on monday finding out things.

                                i know i can call my lawyer and request to skip payment, and so on and so forth but i really don't want to do that yet if i can help it. i mean we were just confirmed on 6/28 and have made 8 payments into the plan. i hate stirring the pot if you know what i mean
