    341 waiting room

    Anyone else waiting for their 341?

    I <gulp> go tomorrow. I'm trying to keep happy shiny thoughts, and reading other no problem 341s help!

    it's very routine....you answer very short and very briefly...it's just questions about did you declare all your income, did you list all the debts you owe. and so on and so forth....but the answers you give should be very brief and very short........if you have an attorney he will more than likely tell you that. We had no problem with our 341

      Ours was in a big room with two tables in an L-shape at the front of the room. That is where the trustee sat and when it was your turn you and your lawyer went up to the front. There were seats in the room and you could either wait in the room or wait out in the hallway. There was no talking in the room, but there were no seats in the hall. She asked everyone basically the same questions and by watching the ones before ours we knew what questions to expect. That way we could ask our lawyer ahead of time if we didn't understand the questions she asked other people or were unsure of how we should answer. So then when it was our turn we were able to answer proptly, confidently and get done quickly. When we were answering our trustee mentioned that she appricated that we watched a few of the 341s before ours.
      It will go quickly.
      Just make sure you know where you are going ahead of time so you don't arrive all stressed and flustered from trying to find the place.

        Same thing here as Jolly.

        2 tables in an L shape.

        The Trustee sat behind the "desk" looking one and the other was just a regular conference type table.

        There was one chair behind the desk for the Trustee. The black box was on the desk. 2 chairs in front of the desk. That's where the Debtor/Filers sit.

        Then at the other table were 2 chairs. The one closest to us was for our attny. The further one was for the Trustee's assistant.

        The Trustee asked everyone the same set of "pat" questions. Then he referred to each person's case file for notes he'd jotted on a top cover sheet. Questions specific to each case.

        We were done and out of there in about 3 minutes but it sure seemed like an eternity.

          Thanks guys! I'm already stressing about the time frame for objections to file.....and the 341 is still 3 hours away! I will feel much better in say...oh 5 years or so ;)

            So, the 341 is over. The group ahead of us was wrought with all kinds of issues (pre-filing courses not done, people filing for 13 when they didn't pass the means test, people who *forgot* to list real estate--but remembered when the tax collector asked, all kinds of nignog issues). The first group went over by 90 minutes!

            After listening and learning for 2 hours it was our turn. It took all of 6 minutes. The Trustee had "one issue" ::::::::::gulp:::::::::: and said if we would agree to his dollar amount he would have no objections. :::::::::::insert racing heartbeat:::::::::::

            $18 more a month. Heckya we agreed to it!

            The plan is only $35 more a month than I had budgeted around for the last 9 months. We included our car in the plan--crammed it. The lesser amount of the car payment, combined with lower insurance premiums starting in August, it makes the Trustee payment sooooooo AOK.

            The Trustee said, make your payments and I will have no problems. Let's just hope the creditors agree!

              Do you mean there were people trying to file a 7 when they didn't pass the means test?

              I was confused by that one

                Congrats, qwerty! Consider this your official early welcome to the 36-60 months Ch 13 club!

                Here's the best part....your creditors don't get to say "yea" or "nay" to your Ch 13 plan. If your trustee says this is the plan and confirms it, all your creditors must go along with it or file an official objection with the court - unlikely if your trustee thinks your plan is good to go Be sure to let us know when you're officially confirmed!

                08/10/11 - DISCHARGED !

                10/02/11 - CASE CLOSED
                Countdown: 60 months paid, 0 months to go

                  Well hotdiggity dog!

                  I think the Trustee said it all when he told a filer's attorney "I get paid to make objections, not make your clients happy". Something to that effect. It wasn't snarky, but rather a "this is my job" statement.
