We have still been waiting on confirmation. Hearing was postponed due to husband getting new job which will put us in 100% plan. We have the payment amount for 100% plan and trustee has agreed.
Our hearing was for this Thursday, however we have postponed again because we filed 3 objections to claims.
ECAST settlement now has about 70% of our debt. They also have $14500 worth of "secured" artwork that we are surrendering and $15,500 worth of a motorcycle and jetski also secured, also surrendering. We filed Feb 15, 2007. ECAST has not called us or attorney to get the items, instead filed an "unsecured" claim on both. So we filed objection to deny claims, because these were secured items they should have picked up, sold, then filed an unsecured claim on the deficiency. Attorney said they have had ample time to do all of that, and hopefully both claims will be denied, which will lower our payments.
Ours has been a big mess and I finally feel hopeful. It looks as our case will be confirmed. We are living on a budget for the first time in our marriage. We have given up the house and toys and credit. Husband has taken a new job where he is gone 3 weeks and home 1 week. But in the midst of all this, we have gotten stronger individuality and as a family. Sometimes I want to think about our stupid mistakes, what we "should have" done...but there is no point in that. We are going to fight to finish this reorganization and start fresh.
