    close to the end

    Well, after almost 3 very hard years, my husband and I are close to the end of our ch 13. We filed in October 2004, which was also the month we made our first payment. The case was confirmed in December 2004.

    Since the plan is for 36 months, is it safe to assume this means 36 months from the time we made our first payment in Oct.? (God, I sure hope so!) Our 36th month will be over after this September.

    I'm curious to hear other people's experiences and any advice they wish they'd had as they neared the end of and/or completed a ch 13.

    What happens next? How soon before my paycheck stops being garnished, and until the case gets reviewed and closed? Will calling the lawyer and/or trustee help along the process? Should I be asking any questions of them?

    I'm just getting anxious and antsy for this to be over. It doesn't seem real. Don't mind me as I long for the time when we can fatten our savings account (which doesn't exist right now) and do some repairs on the house.

    KUDOS to you for making all the way through a Ch13 (I lasted 3 months) ! I don't think it hurts to call your lawyer and/or trustee to remind them your getting close to your final payments, it might help speed up the closing. Any additional amounts taken out that shouldn't be, I would think they will refund you the difference. Others will chime in here to lend their experience.

      Its such a great feeling to be at the end, we are in the same boat you are ...waiting. After the last creditor has been paid the trustee has to do an audit of your case this can take up to 6 months. I called the trustee office this week, wanting to get an update on ours. June 1 was our last disbursement to creditors and our audit should be done by the end of this month, only then if everything checks out o.k. they will send a letter to your employer to stop taking out the money, any overages you have been paid in will be refunded to you. ( A little savings account for us)
