Hi HHM, thank you. I'll address each separate:

    (1) my credit rating - what credit rating lol. I started at 704, I'm now in the 500-528 (depending on which file) due to being behind on the Vehicle which is due to be repo'd and excessive CC accounts, and another Vehicle on my report (which is current). So for my credit- ugh, not much hope right now. I had planned on using the extra money saved from not paying to put towards filing.

    (2) I'd like to keep the furniture, but it's $210 a month, so if they want it, they can have it. I figure it'll be well over a year old by time this all happens, so if they want to come get it they can. It's not a lot, just a sofa, dress, hutch, mattress and box springs. It can be replaced. And, just maybe, they won't think it's worth their time, and maybe, just maybe, they won't come and get it (wishful thinking maybe?)

    (3) The reason to wait for bank statements would be, although I can get copies of his checks that I deposited, it would be hard to prove that I withdrew the money and gave it back to him without a signed aff or depo. I would have no problem getting an affadavit from him, but I would rather not involve him if I don't have to.

    (4) I think the reason for the letter of deficiency is because it would show the amount and also to show the deficiency is well above the value of the vehicle. This is where I was confused. She mentioned something about the deficiency be well over what the vehicle is worth and her filing a motion to prove abuse on their part. I 'm not sure, like I said this was very confusing to me. All I know is that the vehicle is worth less than 1/2 of what I owe, then add all the repo fees, etc. and the letter of sale would show what I owe.

As for filing in the next month or so, it probably won't be for 3-4 more months in order to get all the fees together. And I figure by then, the bank statement situation should solve itself and the repo'd vehicle would have been sold.
