Converting from 13 to 7

our lawyer decided we will qualify to convert to chapt 7, they have filed in July, judge approved and we will have our meeting on the 12th of August. Today i received a letter saying the trustee has not received schedules and means test. SO, fo JULY, they stopped taking the bk payments out of our paycheck. does this mean, i will most likely not have a problem or does this mean they okd because they have not seen the means test. how many people attempted to convert and did not get approved?

Call your lawyer immediately! The trustee either received the amended Means Test from your lawyer and it was misplaced, or your lawyer didn't send your amended forms to the trustee. This needs to be attended to right away. Your lawyer should have received the same letter you did so hopefully he is already taking care of things for you. Keep us posted about what happens, ok?

I filed last year end of July 2006 for chapter 13. In October 2006 I was able to convert my case to Chapter 7, simply by quitting one job. I did not have to resubmit another schedule nor take another means test (I guess it was pretty obvious my income was cut in half) Plus I didn't need to resubmit paystubs, etc etc. I only had to go to another 341 meeting for the conversion (pretty cut and dry) the trustee who was a fill in for the original trustee asked me why I was converting and I said, I don't see myself working 80 a week (mind you not 80 every 2 weeks! 80 in ONE WEEK!) for the rest of my life. I believe the letter is requesting you resubmit another schedule, but as far as the means test, I don't know. Why don't you consult your lawyer on that? I let my lawyer do all the walking and talking for me, quiet frankly he took care of every nook and cranny for me, even though I continued to worry, just a natural thing - everything worked out in the end.

as far as income, im making the same i thnk. i was getting more bonuses last year and im not getting any now but i did get a 5k raise last year after filing, and i gave up the house that is why were converting. i hope my lawyer is doing the right thing here. They better! id hate to be advised i will qualify and then later be told by the court that i dont.
