    Mrs. H - So glad you are not going to allow yourself to be "ROLLED". I would suggest that you and Mr. H run your own set of numbers on the means test. (It's the SAME TEST, but B22C goes on into more detail and is then used to formulate the plan.)

    It's really not that hard! You will have to refer to the some tables, found here:



    Once you have worked these numbers yourself, you will know what you want your attorney to do with them. It's that simple.

    Forget about them dragging Mother into court - ain't gonna happen. He's just skeerin' you up to make you talk.

    And Ril - Sounds like you just talked some sense into yourself!

    You pay rent to your father - it really is that simple.

    This is the micro-managing that we are learning through bankruptcy. Don't worry, you'll be back to your old self in no time, but you'll have an afterglow of better management skills.

      I think that the big difference is that it's our names on the mortgage - my husband bought the house long before I met him. I was added to it once we were married. Ma came along later on. I was thinking about when she even took us out to dinner last and the answer is about a month ago.

      I do hope you're right. It may have been just to get us to say - "You know well she does give us this much money for this or that." But, no, sadly, not true. Neither cash nor check to be had.

      Also - we have run the means test on our own. It comes down to the fact that I know we can manage up to $200 a month to a trustee. That's as much as I could even fathom paying with paring us down. Which, by the way, I have already been doing for over a month now. I want to see just how little we can live off of. Want to be prepared.

      The fact that it is starting to bother me now that it's at the forefront of problems is really besides the point. Taking care of laundry and everything else for her has always been taken for granted. I just don't want a huge payment based on her imaginary income that we never see. How many times have I said that? It's like a broken record.

      Too bad we're not the Springer type. He would love this I bet.

        It really DOES NOT seem fair at all to use Ma's income, but yet NOT to list her for the allowable expenses part. Probably because it isn't fair. So -


        Bingo!

        So ... on Form B22C, see line 40, SubPart B.

        Divide by 3 in the appropriate expenses, according to your judgment, and what you can prove by way of expense receipts.

          Thank you for all of your time and investment in our problem. It is really so very kind.

          I have copied what you just said and pasted it into an e-mail to myself to look into when it's not 2am and I can understand it.

          Husband sleeps like nothing is wrong at all. I'm just jealous. Erratic sleep patterns don't help the situation - that's for sure!

          Fluffy brain again, so I may either post info on another section of this forum about how to cook for people who hate cooking and/or play with and brush the cats. Well, that happens every day anyway. They're lovely and very demanding. We always say "If the cats are happy, everyone's happy." Words we live by here!
