    questions???

    Hi all,
    I'm new here. Great site! Had a few questions:
    I filed a chapter 13 2yrs., 4 months ago in NY state. I am in a payment plan for 5 years. So far so good. The monies are taken right out of my paycheck so its pretty simple. Some years tax return money goes to trustee. Anyways, in that time I have been married. My wife just took a full time job about an hour and a half away. I work full time as well. We are thinking of selling the house and moving. From what I have researched I need a motion to sell the house, and when sold, all/some of the profit of the sale will go to the trustee. Is this accurate? Can I put the house in her name, or sell it to her?
    I am going back to school, full time, in August of 2008. I'll still be in the 13. I will have to let my attorney know this because of the reduced income. If I can't put the house in her name/sell it to her, should I wait until next year to sell the house? Thanks so much. Not sure what to do!

    I think you need permission from the Trustee as what to do because if you sell your house and can make a profit that would mean more money to the creditors? Someone with Asset experience will be sure to chime in.

      What plan are you in? 100%??

        I'm in a 13 plan: 5 year payback. I'll check on the percentage (forgot) but I believe its right around 100. Thanks.
