    Mortgage is getting weird

I filed Ch 13 with 4 months arrears. Trustee has sent nothing to Chase yet. My payments went down $78 in May because I was able to lower my homeowner's insurance almost a thousand dollars.

I am set up to receive alerts from Chase and now for two months, even though I have sent them $824 (the new payment amount) they are sending me alerts, and the monthly "This is not a Bill" statement, indicating that they received 898.

Needless to say, this is screwing up my Quicken books because I am having to account for a payment of $74 that I didn't make.

I know eventually, they will owe me money for the excess escrow that I will be paying through my Ch 13 plan.

Does anyone know how the mortgage companies account for payments during a chapter 13?

I am absolutely certain it is showing what was received. It showed the date, the amount and the breakdown of how it was applied; escrow, principal, and interest until last month when the payment was applied to suspense and there was no breakdown.

I requested a breakdown and they sent me a 12 month history, but that was useless because it only identified the date the payments were made, the amount of the payments and to which month the payment was applied. But no breakdown as to principal, escrow or interest.

Each month there is a running total of YTD interest and YTD principal paid.

I guess each mortgage co. is different as yours is not the first of that I have heard that supplies less info than mine. Have you called an asked for details?

Its extremely hard to get "any information" out of any companies that you are paying thru a Chapter 13. Basically they are too have no contact with you whatsoever, you are supposed to deal directly with the Trustee regarding them.....

Many companies will not even answer you because they are afraid of the Trustee..... all they care about it getting their money from the Trustee.....

So keep good records of what you owe, what you send, and when it is paid.

You should be able to find records of payments thru your Trustee and who is getting paid what and when....

Someone else here on the forum that is in Chapter 13 can supply you with that site link......

        Sorry I was a Chapter 7.....

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.

Besides the fact that I want a perfectly balanced set of books for the household money, my regular payments are being paid outside the plan. That's why I am wanting to know what they are up to...giving me credit for more money than I actually paid. The trustee may not pay anything to the mortgage company for months still. If we had kept that stupid truck, it would have been years before they were paid anything.

The good thing about Chase is now, they will talk to me. They have a special section that will talk to me, except I can't get a straight answer from them. I guess I'll wait for the next "This is not a request for payment" statement and see if they applied the money to suspense again or if they actually applied it to principal, interest and escrow.
