    question about payments

    Ok we are on the verge of chapter 7/13 most likely 13. Right now I am not working but what happens if I go back to work. Do they make us pay more. I am dealing with some health issues but not receiving any disability.
    Filing January 08.

    When a mistake becomes a lesson was it really a mistake?

    If you do wind up in Ch 13, and you were to go back to work, your Plan payments could increase. Depending on your initial %'age of payback. If it's less than 100% to Unsecureds, then most likely your payments would increase.

    If your Plan payments are increase, you'd be allowed "reasonable costs" for working. Gasoline/transportation, clothes if needed, childcare if needed, and such. But any "disposable income" beyond what the Trustee considers "reasonable" for obtaining work will be taken for your Ch 13 Plan.

      I think it depends on the trustee. I was told by my attorney that if I were to go back to work, the payments would not increase.
      I used to have a life, now I have grandkids.

        I am a seasonal tax preparer and was told it didn't matter if I worked.It would not affect our plan or payments.
