    Someone Tell Me This Is Normal

    Okay so I really needed to stay off of Pacer. I have looked up the trustee that is my trustee and now I am scared........

    I have looked up over 30 (yeah I need a life) chapter 13s with this trustee and she has objected to 28 of the plan!!!!!!!!!!!!!! I still have not found a party that has filed pro se either............

    Is this normal do all of the trustees object this much or did I just get "Lucky" with this one??????????

    If I had more time which I don't I might run to the nearest attorney and say have at it but I don't have the time or the money most of this stuff has to be turned in a week from Friday and I am sure that they could not do it this fast.

    I almost wonder if I should leave something out on purpose so she has something to object to as this is her style or to do my best and take my chances that she will look really really hard for something to be wrong.......

    Any and all advice is appreciated!!!!!!!!!!

    My attorney had it filed in 4 working days and it is my understanding that they can do an emergency filing in less time than that. I paid $595 down and that included the filing fees. The rest was paid out with the plan.

    This wreaks of fraud. I don't think I would do that under any circumstances.

      No really there is no fraud!!!!!!!

      I have nothing to hide except that I have never done one of these before and am scared to death that I am going to make many many mistakes and have it thrown out.

      I do all of my own legal work and never usually am worried about it. I am a perfectionist when it comes to this stuff so I guess I am just nervous because she is objecting to everything. I have read where she has objected to everything from the debtors not making enough money to not having 6 months of check stubs (which my papers say only 2 months worth ) and anything and everything in between.

      I am claiming adoption subsidy which I am not required to do so if anything I am being too honest and that always seems to come back and bite me in the butt.......

      The attorney here that says he does them has not filed a 13 since 2002 and he is super slow and since I have already filed the petition I don't have time for that so the plan still is that I finish what I started on my own but I feel many many sleepless nights to come

        Actually, it is quite common for the chapter 13 trustee to file some sort of objection to the initial petition or plan, usually over some technical matter. However, 90% of the time, these objections are resolved before the confirmation hearing.

        So, to answer your question, YES, it is normal to have some objection filed by the trustee in a chapter 13 case.

          And don't be surprised if the Trustee eeks a bit more money out of your budget to pay toward plan payments. When you submit your plan to the Court, you submit a proposed plan. From there, details have to be worked out. So the Trustee may take a bit of money from this area, and bit from that area to increase your payments into your plan.

                You will have a Pacer "bill" that will choke a horse................!!!!

                When you start pulling up lots and lots of different cases, all the documents you look at - IT COST................

                  Please stop for 2 reasons, (1) you are charged a per page fee that will add up, (2) your case is your case...looking at other people's cases will do you little good.

                  You need to think long and hard about your own chapter 13, and remember, you only have 15 days from the date you file your petition to file the chapter 13 payment plan. Also, since it sounds like you are doing this pro-se, I can almost gaurantee the trustee will object to something. In fact, I generally recommened that people DO NOT file chapter 13's pro se (i.e. without an attorney) because there are too many pitfalls and there are too many things you do not know that can really hurt you in a chapter 13.

                    Sinking Fast is correct. It appears that the trustee usually does not confirm a plan based on the first submission. Mine was objected too, our attorney forewarned us that it would. He wanted to see where the trustee was coming from. We ended up with a payment much lower than I had anticipated. So it definitely was worth the wait. Good Luck.

                      I have a very good attorney and ours was rejected because we needed to add one more month to the plan. We are old law. Added the month and it was confirmed. Little did I know then that the IRS would be adding 2 1/2 more months!! Good luck. You are brave to go this alone.
