    Creditors who filed claims...

    I'm curios as to the experiences of those who filed chapter 13 and how many creditors filed claims.

    What was your total debt, and how much of that amount was filed as a claim after your chapter 13 filing?

    All of my creditors filed claims, pretty close to the amounts I had set up.

      Same for me, all filed claims. Some came in under what I listed because they apparently deducted the last interest charge.
      I used to have a life, now I have grandkids.

        My attorney said it would be likely that some would drop out.

        It will be interesting to see what happens.

        I'm surprised by the two answers above.

          INH2, our Ch 13 members' experiences vary widely about how many of their creditors actually file claims. The amount of money owed doesn't seem to matter - some creditors that are owed multiple thousands don't file a claim, and some creditors (especially small, local creditors) will file to get $100 back.

          In our case, about half of our non-secured creditors filed claims and the other half wrote us off. I couldn't see any pattern for who filed claims and who didn't. Who knows???

          09/27/07 - Confirmed at last!
          06/10/11 - Trustee confirms all payments made
          08/10/11 - DISCHARGED !

          10/02/11 - CASE CLOSED
          Countdown: 60 months paid, 0 months to go

            All of my creditors filed claims except one (american express) and it was very odd because I had two accounts with them one gold and one blue. The gold filed claim but blue did not. I was surprised because american express has always seemed to be aggressive.

              In Massachusetts I am paying $2000 plus another $750 that apparently I can have included in my Chapter 13, I am expecting to have $200 approx payments to 3 years and all of my debt goes away.

                My american express collection agencies keep selling off my debt....my understanding of the whole thing that is killing my pathetic credit score.

                  Our attorney (in CA) told us that often some of the bigger creditors (ie, Chase, B of A, etc) of unsecured ccs don't file claims. He didn't mention any that *never* file, though. But, as others here have said, it seems to vary widely. We are filing next Friday, so we'll have to see what happens in our case. Good luck!

                    I had 78 unsecured creditors total. (lots of dr bills, past repo's. apartment lease breakage fees etc and credit card debt) Of that 10 filed claims. I am close now to being done with it all.

                      I had 46 unsecured creditors of which 39 filed claims close to what i said in amounts..some under.....it's totally funded now though, but i have to say that all the major credit card companies DID file claims, MBNA, Chase, Citi, Bank of America, and so on. There is no rhym or reason to who files and who doesn't..........one of them didn't file cause they sold the debt to someone else and they ran out of time to file the claim however they did send me a warrant in debt which was a BIG NO NO!! After the lawyer talked to them though, they very happily withdrew the warrant

                        I have 30 unsecured creditors, 15 have filed claims so far. I filed 3 months ago.

                        All the biggies except CITI and BofA have filed and I'm expecting that any day but who knows?.The small local ones have not filed claims.

                        A company,ecast settlement , apparently collection company, has 6 of the 15 claims for over half my total debt....so if my case is not confirmed, I'm betting they will be the ones to sue me first. I'm watching this close, because it looks like ecast filed a claim for CHASE that CHASE already filed.

                          you need to let your lawyer know if you suspect mutliple claims filed for the same debt. Your lawyer can object to the duplication of the claims, thereby only paying the amount 1 time. Ecast is notorious. I had a couple of creditors file claims twice and objected both times and the duplication was removed. Watch it closely and object. It won't upset the applecart if you object to paying the same claim more than once. Just have documentation to show the duplication. good luck!

                            Dont they only get 60 days to file a claim and that's it???

                              Creditors get 60 days to file a claim in Ch 7. However, in Ch 13 creditors get 90 days to file a claim and the government (typically the IRS) gets 120 days.

                              That's about the split in our Ch 13 case. No rhyme or reason for who filed claims and who didn't either.
