    Time Frame for Claims

    Can anyone give me an idea of the timeframe that most companies submit claims in a 13. My brother deadline for claims in June 23rd. He had 13 creditors submit claims within the first few weeks and then nothing since. He is in a 100% payback so his comfirmation hearing has been continued until July 11. Only has had 25000 claims out of 85000 total. Will they all come at the last minute or will some of them not submit claims. What has been everyone's experience?

    Mine was like your brother's. All came in the beginning, then none for the rest of the time. We only had about 30k out of 76 k
    Filed CH7 - 10/13/05;
    341 Meetings: 11/28/05, 3/20/06, 12/4/07 (3d time's a charm!)
    Converted: 2/15/06 (to CH13), 10/15/07 (Back to CH7)
    DISCHARGED: 2/15/08

      wow...well hopefully his will be the same!! If anyone else can give me their experience it would be greatly appreciated.

        In our case, all of our secured creditors filed claims within the first six weeks after we filed. and 2/3 of our non-secured creditors who filed claims did so in the same time frame. The last 1/3 straggled in one by one here and there right up until the deadline. When the dust settled, only about half of our non-secured creditors actually did file claims. There was no pattern to which non-secured creditors filed claims either. One of our highest owed cc's ($12K) didn't bother, while several small cc's that we owed only $300-$500 to did file claims.

        Since only half of our non-secured creditors ended up filing claims, if we continue making the monthly payments we are currently assigned, our non-secureds that did file will all end up getting 100% of their money back. Of course, the ones that didn't file claims will get nothing.

        There's just no way to tell until after the 90 days after the first 341 meeting that the non-secureds have (and the 180 days the government has) to file claims exactly how many of your brother's creditors will actually have to be paid through his plan. Hope the number of his non-secureds that file claims ends up as low as ours was.

        07/18/06 - Confirmation Hearing - not confirmed, 3 objections
        10/05/06 - Hearing to resolve 2 trustee objections
        01/24/07 - Judge dismisses mortgage company objection
        09/27/07 - Confirmed at last!
        06/10/11 - Trustee confirms all payments made
        08/10/11 - DISCHARGED !

        10/02/11 - CASE CLOSED

          Every one of my unsecureds filed a claim. The total was only 26K, but all filed. The lowest was for 156.00 and the was Walmart, and they filed first. The largest was Am Express and they filed their claims 2 weeks before the deadline.
          Most filed fairly quickly, but there were a few lagards.

          One final note about mine that may make a difference. I was current on all of my payments the day I filed, I even made payments to a few of them the week before I filed.
          I used to have a life, now I have grandkids.
