    When it Rains...

    So we filed Ch 13 in Feb. We are surrendering the house. Moved into this house last week of December. Our friends purchased the house and were going to owner finance to us. After we moved in, the homeowners association came over and wanted to know if we were owners. We told them we were buying the house from the seller. After we met with attorney, he advised to not do owner finance b/c it may create equity problems in Ch 13. He advised to straight out lease. So we all agreed. Wrote up lease agreement and back dated it to when we moved in.

    Now we find out that this homeowners association doesn't allow "renters". It is in their covenants. We got letters to vacate in 60 days unless we can show we are owners. I panicked and emailed attorney asking if trustee would let us do this since our plan wasn't confirmed yet. Waiting for call back from her.

    This is the week we are waiting for trustee objections to plan. We have been in this house 4 months... and now may have to find a way to move again?? We couldn't find a house to rent 5 months ago that didn't require credit check.

    I really hope that the saying "what doesn't kill you makes you stronger" is true. Having to move my teenagers AGAIN....

    Maybe this is God working b/c attorney said trustee may object to my rent being to high. Maybe I'm supposed to move and this is a way to move without breaking a lease.

    What a mess, dovette . So sorry to hear you are having to wade through this latest crisis.

    Since it looks like you will need to move again, when you look at rentals, consider being upfront about being in Ch 13 and emphasize how you are in a debt repayment plan over time - you are not running away from your debts but are paying back part of what you owe your creditors. Hopefully you will find a sympathetic landlord who may have dealt with their own or a family member's personal financial problems in the past and will overlook a bk on your credit report because you were upfront about it to start with. We have had other members on the board who found nice places to live during Ch 13 after explaining their situation - hopefully you will as well. Keep venting as needed - hang in there!

      Homeowners Assoc are soooo stuck up .. who cares if your renters ??? Your paying the bill ! ! ! Sorry to here that you have to deal with this crap.

        Oh Gosh, Dovette!!

        We were in a similar situation only we had the Landlord from Hell. We had to move again, so I can sympathize with you. Teenagers here too. So I can really sympathize with you.

        I'll pray for you that you are lead to THE home for your family.
