Just made my 12th payment...

    Just made my 12th payment...

    Well, just had a milestone, 12th payment into my plan and over the weekend will mark the 1 year point since filing. I'm 20% done.

    I am encouraged at the number of people posting lately that made it through the entire ordeal.

    What is Bankrutpcy done for me...

    1) Trashed my credit, though the numbers are climbing a little each month...time does help to heal things.
    2) Caused me to deal with my gambling addiction...get help...and when this Chapter 13 is over with, I will be able to obtain the things in life that are important...not setting at a slot machine or poker table.
    3) Learned to live without credit cards. Tough as hell, especially when you have those unexpected things pop up.
    4) Erased 150K in credit card debt, something I would never have been able to pay off and should allow me to retire some day provided the good Lord has plans for me to live that long.

    Anyways, good luck to those who are just starting, congratulations to those who have completed, and continued strength to make it work for those still doing it.

    Congradulations ! Im through with my Bk too. But one thing I could not give up is gambling. But now that I don't have cc's I feel I'm more in control. My SO takes a certain amount of paycheck so I'm not gambling my "rent," and "car note," and utility bills. The rest is mine.

      Congrats and big pats on the back on making it through Year 1 of Ch 13, aa! You've had your struggles this last year - so glad things have smoothed out a bit. You are so right that Ch 13 is a life-changing experience! Wish we had learned our lessons decades ago, but better late than never.

        I hear ya about pondering past choices and looking toward the future.

        Hopefully we too will live long enough to build up some savings before retirement age hits as well. Although, our Golden years aren't looking so Golden now.

        BUT, we're debt free and we have many other blessings to celebrate!!

          1) Yes, your credit was trashed, but the damage is done. The worst is over now and you are actually beginning to rebuild your credit again.
          2) You should be so proud of yourself. Any addiction is hard to kick.
          3) I agree with you on the credit cards. I will cut my hands off before I ever have another credit card again.
          4) I had almost $95K of credit card debt. If I had not filed bankruptcy, I would never be able to retire.

          Next month will be 2 years paid into my bankruptcy. Only, ha, ha, 36 more payments to go and I will be free. Hang in there. We will get through this together.

            Beyond getting the finances back in order,................ Pulling yourself away from the addiction that put you into this position to start with is really your crowning achievement.

              if you don't mind me asking, what is your monthly payment? For 150K in debt, I was wondering. Mine is 50K but I'm wondering what they'll ask of me if I choose to file. Mine is due to playing the slots too.
              I won 50K last august and now i'm 50K in debt because of it...

                Citygirl, your payment isn't directly related to the amount of debt you have, but your disposible income. You could be anywhere from a 0 percent payback (unusual) to a 100% payback (unusual). My payback is around 15% but will be a little higher than that because I had to send a tax refund to them.

                  do you mean 15% of the total debt ?
                  What is your payment and what is your debt so I have an idea.
                  Also, what is that in alliance with your income?

                    No, aa means he/she is paying back 15% of the debt from those creditors that filed claims before the deadline. When a non-secured creditor doesn't file a claim, then they get nothing.

                    In Ch 13, what matters is how much monthly disposable income shows on the required Means Test after all the parts are completed - that is what sets your monthly Ch 13 payment. Even if aa gives you his/her actual figures, they can't help you for your own case.

                    Your Ch 13 payment is set by how you come out on the Means Test which does a complicated comparison of income, required IRS and local expenses for housing, utlities, and transportation, and real expenses.

                    Two people with the same income and real expenses can still come out with very different Ch 13 payments depending on the amount of secured and unsecured debt they have and how many of their non-secured creditors file claims. (You can thank Congress for this ungodly mess.)
