Chapter 13 to 7

Hi, I was wondering how long after filing chapter 7 can you file again,
we filed chapter 13 in Nov 06 (credit card,auto loans etc)because we were told by our attroney that we could not do a 7 again
because we filed a 7 in Feb 1999 (laid off)
we really wanted to file 7 because we can't afford the plan in 13
please someone tell me how much longer do we have to wait to convert to 7

p.s we also have a house and we have no equity,so if we have to loose the house that is fine,just don't know anyone who rents to people who have bad credit in Ohio

I believe the waiting term between chapter 7 filings is 8 years??? Not sure but I do believe that, so you are technically past that time frame. Side note, as long as you are current with your mortgage and it falls under the homestead equity exemption, you should not have to lose your home if you convert.

so does the eight years to file 7 again start from the time you filed 7 or when your 7 was discharged,thanks again

The 8 years between Chapter 7's goes by the filing date.

If you can convert to Ch7 from a Ch13, it doesnt take long IF you qualify past the 8 years. I was in Ch13 for a little over 2 months and converted to Ch7 after the Trustee objected to confirmation of my plan for $250 a month. He sent me to the judge and wanted $800 a month. My choice was to quit one job for several months or pay $800 for the next 5 years. You do the math!
