    In Chapter 13, they can and often do, unless the debtor does a 100% repayment plan.

      This is the major recruiter for the accounting industry in my hometown. They have all the good jobs, and that's what I am saying, they won't even present my resume to their client, my potential employer. Their only suggestion was to go the temp to perm route, which pays substantially less than a direct hire position. So much so, that day care would eat half of my check.

      Like the trustee would hire me. Yea right. I'm not really being pessismistic, just being very doubtful.

        With a six figure income, I'd gladly pay back 100%. And if we lose the truck, and don't have to pay for it, I could be out in about 18 months. Too cool. Oh how I love to dream

          We are accepting this fact and working to find hubby a job, but no luck yet.

          Since the truck is not parked at the house and could be anywhere in the lower 48 states when I go to court and since there is a 53' trailer behind it that doesn't belong to the creditor, not to mention our personal stuff that is inside it while he is working such as radio, microwave, tv, dvd etc....how will this work?

          Will they give us X days to return it or will they just find it and repo where they find it, leaving hubby stranded? What about the trailer that is attached to it or the generator that is mounted that we are making lease payments on each month?

          Stupid attorney #2 is not answering calls or returning emails.

          Attorney #2 filed a response to the motion to lift the stay but he didn't address all the points in the motion, should he have addressed every point?
