    Open 13 - Credit report shows balances and current month Charge Off

    I filed 13 in July 2005. I just joined Trucredit.com and pulled my credit reports. Most of my accounts reflect IIB or Wage Earners plan, however several of them are reflecting balances and one keeps reporting "Charge Off" in the current month ( and for the last 20 months...)

    So my question is what is the law regarding showing balances for an active Chapter 13? Does anyone have a form letter that I can send to the Credit Reporting Angencies? I have searched, but most of what I found related to after the discharge (and then mostly Chapter 7) not during.

    Good Luck with that! Filing a Chpt. 13 will do all types of crazy things to your credit report and getting it fixed can be a nightmare. Just writing the credit bureaus is not likely to do much good, because they just report what the lenders tell them to report.

    You might have some success in filing an intial challenge to the items in question with the credit bureau and hope the creditor will change it or that their records are in such disarray that they just delete it, but once they reaffirm the information--you will have to deal directly with the creditor to get it changed and if it is a large bureaucratic type organization that can be a complete nightmare.

    Theoretically, you could file a motion with the court to get some relief, but that would require your lawyer to want to take the time to do that and if there is no monetary damages at stake that is not likely to occur.

My cc report was similiar I went to annualcreditreport.com you can view all 3 - the first time is free - so if you haven't tried that site give it a shot. I had about 11 creditors and most say "Wage Earner Plan (that was when I was in Ch13)" I know all 3 reports do show Discharged in Bk. I honestly don't know exactly what the report should reveal, theres so many.
      So my question is what is the law regarding showing balances for an active Chapter 13? Does anyone have a form letter that I can send to the Credit Reporting Angencies? Usually you can just write on a piece of paper with a list of creditors your disputing. Include your name/address/ssn and a copy of your drivers license. I have searched, but most of what I found related to after the discharge (and then mostly Chapter 7) not during.
