    Finally filed... 341 meeting this week... what to expect?

    I have my 341 meeting this Thursday for my chapter 13. Is there anything I should expect or any surprises I should worry about?

    Also, I'm getting married in June, I was told by my lawyer that any gifts I recieve can't be touched because I'm the only one filing. Is that true?

    OH WOW, congradulations on getting married first off. Yeah, your lawyer could be right, especially if its monetary or something of great value the Trustee could take and/or turn into cash to pay back the creditors.

      Any gifts that your WIFE receives can't be touched. However, since your Ch 13 case won't be closed by June, any gifts that YOU receive for the wedding could be interpreted as belonging to the trustee as a part of your estate.

      Since wedding gifts are typically given to both of you equally, that makes for an interesting dilemma. Anyone ever heard of a situation where a trustee asked for half of the value of wedding gifts when a debtor was married after filing but before their case was discharged? (Don't want to scare you, jzak - this would be very unusual.) Your lawyer probably knows your trustee's customs and feels confident that he/she won't come after the gifts.

      06/10/11 - Trustee confirms all payments made
      08/10/11 - DISCHARGED !

      10/02/11 - CASE CLOSED
