    Trustee reminder about taxes

    We received a letter in the mail from our trustee today....my stomach does a funny flip-flop every time I see our trustee's name and letterhead on an envelope...gulp! This letter was just to remind us that he expects to receive a copy of our filed 2006 federal and state income tax forms before May 15, and if we file an extension, he wants to know about that within 14 days too. If we don't provide them to him by the deadline, he will dismiss our case (no surprise there...duh! ).

    Since tax time is inching closer, are any other 13ers here getting letters or calls from their trustee's office reminding them to send in their income tax forms?

    07/18/06 - Confirmation Hearing - not confirmed, 3 objections

    01/24/07 - Judge dismisses mortgage company objection
    09/27/07 - Confirmed at last!
    06/10/11 - Trustee confirms all payments made
    08/10/11 - DISCHARGED !

    10/02/11 - CASE CLOSED
    Countdown: 60 months paid, 0 months to go

    When I was in Ch13, I was required to have my taxes filed within 10 days of the filing date, whether I owed or not. The Trustee was going to take any return (accept for $250 or less). Regardless, the Trustee wasn't going to get anything since I'll have owed money to the govt.

      I am glad that I am old law. Don't have to turn in taxes at all and refund is ours to keep. I took my daughter to the eye doctor yesterday and she needs glasses. They ended up costing $350. We could have chose cheaper frames, but at thirteen, she is very self conscious and wanted her to pick a pair that she felt comfortable wearing. This is when a 13 is tough, manuvering around to afford glasses. Oh well, we just won't eat!! I need to lose weight anyway.

        When I asked about taxes....

        At my attorney's office -- I thought everyone in a 13 had to submit their taxes to the trustee, but it was the refund that was case by case or whatever.

        So I was calling to see if I was supposed to send the tax returns to the lawyer's office, and then they forward it on, or if I was supposed to send it directly, or what. He says, nope, you don't have to send your taxes at all. If you did, you would have gotten a letter -- and I know the letters have gone out from the trustee's office, because other of our clients are calling with questions.

        So, no returns to be submitted, no refund to be surrendered! Happy day!

          Our attorney says we can keep our refund and they will just take a copy of our taxes "in case " the trustee ask for it. Hopefully not.

            We are old law. So far no letter requesting tax info. We kept refund for 05. As you may know from a previous post of mine, we owe this year.

              We're old law and i get that same "ugly" LOL feeling in my gut when i see our trustees name on an envelope too.. we're in Nevada, and we also got that same letter asking for our filed return for 2006... we've had to give up the last 3 refunds, but are waiting to see if the trustee takes this years return..

                I'm not a 13'r, Lrprn, but we got a stinky tax letter too.

                About a month after our 341 Meeting, the Trustee sent a letter "reminding" us that our Discharge and subsequent Closing was contingent on submitting our filed taxes with him. That we were not allowed to get any refund via Direct Deposit and we could not cash any Refund check we received until our Trustee was satisfied with our taxes.

                Our attny had already told us the Trustee doesn't usually go after a refund unless it's in excess of $1K. Federal and State together, we're not getting anywhere near that much.

                We had to sign and return the letter to verify that we had read and understood it.

                Discharged - 12/2006
                Officially Declared No Asset - 03/2007
                Closed - 04/2007

                  I am under the old law. My trustee has never wanted my tax refunds. Not that I get alot back, but it is nice to have.

                    trustee letter

                    Well it happened this morning. I opened the mailbox and there was a envelope with the trustee's name on it. I started freak until I opened it and it was just a reminder that I had to show my taxes are filed by April 30th.

                    54 months to go!!!!!!!!!

                      We received a letter this week from our lawyer telling us that we are allowed to keep up to $2,000 from our 2006 tax refund. Wooeeeee! Sure didn't expect that! We do have a little coming back after our federal and two state returns are combined, so that sum will go into an emergency fund for those unexpected emergencies that are bound to happen over a five-year Ch 13.

                        I got a letter from my new trustee today. They get all refunds, no matter how big or small Mine is $550 this year, but every little bit helps...oh well...only 24 months to go.

                        Converted: 2/15/06 (to CH13), 10/15/07 (Back to CH7)
