    How to file taxes?

    This is our first year filing taxesin the bankruptcy. I was just looking over my papers about how to file. Our atty told us we could not do any of the refund anticipation loans, but other than that we would get our whole refund. Now why I am looking at the papers, it says not to file electronically. I am confused. I called the atty, and he said ust file, but do not take any loans against it b/c you can not give up the money for the fees they charge.

    HOW do I do this? Do I have to file by paper? Can I submit online? Does anyone know how long it takes to get your refund if you file by paper?

      I am in Ohio also. We have been in a 13 for 20 months and we did file last year and you are correct the trustee told us that we could file electronically, but not get the refund directly deposited into our account. He said that since we are in a 13 that having the direct deposit might throw up a red flag with the IRS and delay the refund. Don't ask me why, but that is what we were told. So we efiled and receive a check in the mail. Good luck!! Are you in Northern or Southern District? I am in Southern District.

        My attorney said I don't have to submit copies of my taxes. He looked at my case....so I think that's ok.

        I asked him about e-filing, and e-refunding. He said both are fine, but after hearing others on this site say about the e-refund, automatically depositing to your checking account, I think I will e-file but get a paper check.

        I'll post and let you know how it goes -- Im still waiting on a W-2.

          First, thank you for the replies. I am in the southern district also.

          I finally talked to my atty who flat out told me he did not know. He is a piece of work. I called the trustee office and they never called me back. I also called 6 different H&R Blocks, and they ALL told me I could e-file through them, just no rapid refund. That is all I was told at the 341 also, that I could not get a money now loan, or a refund anticipation loan.

          SO, I am going to e-file, and get the check mailed to me.

          Next question, do you remember how long it took to get the paper check mailed to you?

              I should also mention that I am an old chapter 13 participant.

                I have e-filed, in Georgia, for the pass two years. There was always a small delay in getting my refund deposited into my account. I called the IRS and they stated that they were awaiting permission from my trustee to release the funds.

                This whole process usually took from 5-10 business days.
                09/16/2004 - Filed Ch 13
                10/28/2004 - 341 Meeting - done
                12/16/2004 - Date Confirmed
                - Date Closed

                  I am in Maryland. My attorney advised us to file the "old fashioned" way, which means to send in the paper form and wait for the check. That way, he said, avoids all red flags. I did it last year and got both checks without any problems.
