Emergencies during the plan?

    aa06a47, I wish I could find a job under the table but they never appear when you need one. Honestly I it would be more then figured, so we are just holding our breath. Our trustee did not ever say anything about having to send in Tax papers, nothing was written to that affect in our confirmation letter from the courts, so we are in the waiting period.
    I am now going to cut back on my income so we fall back into range. But alot of changes have taken place.Our home which is my dads , is supposed to be willed to us and we are suppose to sign papers to the affect. So we are going to have to take on full responsability of all repairs and up keep, plus taxes and liability insurance, which obviously none of this is in our plan so we would have to ammend our plan. I would love to be able to do it sooner than later so we would be safe. The house needs MAJOR repairs.

      Be careful about getting property signed over into your name while your in the chapter 13. Inheritance becomes property of the trustee. So, if your dad is still alive, he should look at other ways to give you the property, such as a spendthrift trust. Seek the advice of a company that specilizes in setting up a trust to protect the property.

        The property will be willed to me, as my lawyer said, "Do not let your father die while you are in a chapter 13"! Plus we will see if my father really follows thru with his plan.

          That is good, as long as he doesn't die! If the property is of any great value that you wish to keep, then I would still try and find a way to have it put in a trust that shields it from even a trustee. They do exist.
