    meeeting of creditors

    Hi, I recieved a notice for the frist meeting of the creditors today.
    Is there more than one meeting of the creditors?
    Also we were told to mail our last two years tax return,and home,and car insurance to the trustee/court,right before this meeting.
    Is this normal?Does that mean the trustee will take our 2006 tax refund?

    First, that is all normal. And, If you fail to comply with the request, your BK will be dismissed.

    Second, there is typically only one meeting of creditors, what is known as a 341 meeting (341 is the BK code section in which the meeting is mandated). A creditor or the trustee can request an additional meeting (which is known as a 2004 exam), but that is rare. Sometimes, if the BK Trustee needs additional information, he will "continue" the 341 meeting to another date, but again, that is rare.

    As for the tax refund, if you filed a chapter 13, then probably not.

      If some sort of problem arises with your filing, the Court can schedule another Meeting of the Creditors. But in most cases, there's generally only one 341 Meeting.

      We gave our attny copies of all the info (insurance policies and such) you were asked for in the letter from the Court. All that stuff was part of our attny's original request for docs. I don't know if the Trustee asked our attny for the info or not. But if the Trustee did request any of that information, our attny had it on file.

      The Court gets copies of your last 2 year's income tax returns. That's standard. Whether or not the Trustee will lay claim to your income tax refund is strictly up to the Trustee. Some do, some don't. If you typically get bigger refunds, you might want to modify your withholdings to have as little income tax withheld as possible for the rest of the year.

        The Trustee for the state of Virginia, takes your refund every year while in Chapter 13. He will only give you back $250 of your refund (no matter what your refund is).
