Hi All, I did it! I put my 2 weeks notice in to my day job. Just to give you quick update. I was working 2 full time jobs which threw me over the state median and threw me into chapter 13. The trustee did not like my attorney's proposed plan of $250 a month. Even though the median test proved I had no disposable income, schedules I and J proved I had more than the lawyer proposed ($800 disposable). Well we went to court to hear what the judge had to say and he didn't want to make a decision, so he gave the attorney 20days to resubmit another plan.
My choices:
1. Move to a more expensive place, eat out more etc to eat up my disposable income (under IRS standards of course) as I'm a frugal person, but I can't help that my rent is "cheap," compared to nowadays for my area (state of VA, Falls Church)
2. Quit one job and file for a 7
3. Agree to a payment plan of $800 (the trustee does not compromise well when he knows he can make more money!
The judge said I'm not forced to work one job, so that was the biggest hint to just quit one job and refile for a 7. I have given it alot of thought and it only makes sense, living under chapter 13 for the next 5 years and giving "disposable income," to the trustee and giving up my PERSONAL financial records every year and any tax returns I get - just did not make sense.
I would be living tight with or without the 2nd job. The lawyer said after a month or so I can pickup a part time job if I wanted to. That seems more realistic! So here we go, hope things work out to that big DISCHARGE at the end of the tunnel!
I'll keep everyone posted in case anyone else might have a similiar conversion case from Chapter 13 to Chapter 7.
