    Trustee wants letter that husband can’t work

    My husband has severe PTSD and is unable to work. He was admitted as an inpatient He is in partial program from8-2.I have amended our plan for a lesser amount. The trustee is wanting a letter from his physician that he cannot work. I don’t know if the physician will do this. I owe roughly 6k until next December. If I voluntarily leave my bankruptcy what will happen? I am current on my home and car payments .

    The physician should be able to provide a letter that shows that he can't work. Did you ask your attorney? I'm guessing you are only seeking an abatement (reduction) in the payment. If you are seeking a hardship discharge, then you wil need to prove that and you will need medical or other evidence. You may also ask your attorney about a conversion to Chapter 7.

    However, you must think about the affects of dismissing your case, or converting to a Chapter 7. If you filed Chapter 13 to save your home by paying arrears, past due income taxes, or for other reasons, dismissal could be bad.
