    Going beyond 60 months?

    Do these things ever go beyond 60 months?

    Background: We are in a 100% plan, though it didn't start that way. First payment was made July 20, 2017. In April 2020 we were bumped to 100%. The way I see it is our last payment would be June 30th (I am paid twice monthly, so it would be the 12oth payment). I asked my attorney to confirm that was correct and her assistant came back with " I reached out to the trustee's office and you have roughly 4 months left. They will be conducting an audit of your case within the next two months and coordinate a takeover date for you to take over your mortgage." I guess 4 months from today would be 5 years since we started, but I was really looking for a solid answer that June 30th is in fact the final payment. Has there ever been a time when they've collected beyond 60 months? We have been extremely fortunate in these 5 years that we've managed to keep our heads above water, but I am beyond ready for this to be over.

    ETA: I had asked about finding my base plan number previously, but was never able to find it anywhere on PACER.

    You will not find your plan base on PACER. That number is maintained by the Chapter 13 Trustee. It is usually up to date and available on the National Data Center's website (ndc.org).

    As for plan duration, it is usually 60 months after your first payment. Since the first payment comes 30 days after filing, it's usually 60 months from your first payment. Example: file on January 1, 2020, first payment is February 1, 2020. Your plan payment period will end with your payment on January 1, 2025 in a 60-month plan.

    I can't account for those paid bi-weekly but you are in the ball park.

    You have to remember, that you're in a 100% plan. That's probably why they say approximately 4 months based on your current payment and the remaining Plan Base.

      Thanks for the info.

      My plan base says $0.00 on NDC. It just tells me what I've paid in so far.

        Your Trustee may use a different system such as 13 Network. You may need to ask your Trustee or visit your Trustee's website. Sometimes the Trustee's website has information about accessing your ledger using their specific system.

        (There was an old system called '13 Data Network' but they combined with the NDC.)
