I am trying to determine the final payment of my ch13. I asked my attorney and she was no help and said it is not an exact science but I mentioned she should know approximately. I made my first payment in Sep 2017 and monthly thereafter. My ch13 was confirmed in Dec 2017. To date I have made 50 payments. My November 1st payment will make 51. Do I go 60 months from the date confirmed or 60 months when I made my first payment? The last 53-60 months my plan is supposed to increase an additional $335 per month and NDC shows the increase starting Jan 2022. That would put the end date at Aug 2022. That is over 60 months from my payment start date not to mention the confirmation date. We did modify the plan in Dec 2019 because the payments were too high when I got divorced and had to pay child support and alimony. I have never missed a BK payment. Below is my pay plan which is referenced on the modified plan.
$570 per month for months 1-4 prior to confirmation (1st payment Sep 2017)
$1,225 per month for months 5 up to plan confirmation
$1,697 per month up to month 18 after confirmation
$885 per month for months 19-52 after confirmation
$1,220 per month for months 53-60 after confirmation for a total of sixty months
I made the one payment of $1,225.00 by check and noticed there were 20 payments at $1,697.00 which was due to a delay in payroll deduction of making the change to $885.00.
The trustee report I just received shows a balance of $6,731.00. I am paying off the base plan which is only $500 less than 100%.
Do I have 10 payments left which makes 60 payments or does it go longer?
