    Question re: C13 Payment schedule

I just received a preliminary schedule of my payment plan from the Trustee assigned to my case (haven't even had my 341 yet!). There are no "due dates" on this schedule, just a month and year. Is this a common thing, meaning the payment has to be received for that month sometime during that month, or will there be a more exact date requirement that I have to negociate?

Your first payment is generally due 30 days after you file, and then at the same time each month after that. So, if you file on the 10th, your first payment is due on the 10th of the following month, and each payment thereafter is due on the 10th.

And don't forget that you start making the payments immediately--you don't wait until your plan is confirmed.

If you file Ch 13, then the first payment is due to the trustee within 30 days after the plan is filed.

I would recommend having your trustee submit to have your payments taken directly out of your salary. Less chance of making the really bad mistake of paying late or making the decision to just not pay. If you never touch the money, it's a lot easier to not miss it.

            Trustee Payments

Im filing in the state of Virginia, my Trustee wanted 1st payment no less than two days after the 341 meeting, also I don't have a choice as far as payments, as soon as a final plan is confirmed, they will send a letter to my employer requesting a "wage order," same thing as garnishment, so they make sure i dont miss a payment, which is a good thing .. but i dont like the plan they are going to the judge to request

Thanks for the replies, everyone. I think I'll just have to send the trustee an email about it. Having it due on the anniversary of my filing is OK, I guess, but making it a week later would be much better. We'll see.

I'm torn on the whole payroll deduction part. I'll have to decide if that's best for my situation, so we'll see there, too.
