I wanted to give an update - I had asked a few months ago how the buying process went for needing a car in a chapter 13.
This is how it works in Eastern Kentucky.
I spoke to my lawyer and explained the situation; I have a 2006 car that I have recently put nearly $1k in. She wanted me to wait until it finally died to get a new one, but having kids to get to school and me to work, I don't have the luxury of waiting. I am single and only have one car.
I got the forms from my attorney to incur additional debt while in the 13 today. According to her, I will keep paying my same monthly amount to the trustee, but now unsecured creditors will get less. That works out great for me, the trustee will pay the car payment, and by the end of the bankruptcy, I will have a nearly paid for car.
