    Form 4100R Final Cure Payment

    The google didn't cough up an answer. Is form 4100R proof that my lien is officially stripped? It looks like something I can send the the mortgage servicer and the court house. Maybe to ensure my second is gone from all records for eternity.

    No. That form has to do with payment of prepetition arrears and post petition payments on a mortgage on a personal residence. Since you are stripping your 2nd, I assume it has to do with your first mortgage.

      I checked the number associated with the document. You are absolutely correct! Will I get something that is proof of lien strip too?

        This was from my attorney, I hope it helps:

        Once your discharge order is signed by the bankruptcy judge, the junior mortgage lienholder must release the lien on your real property.

        The agreed order that was entered includes a provision that in the event the lien is not released, you may obtain a certified copy of the order entered in the adversary case and file that certified order with the county recorder’s office to effect a lien release.



        I recommend the following:

        - Contact the second mortgage lender and request to speak with the bankruptcy department. Reference your bankruptcy case number, the adversary case number, and provisions of the attached order. Request the mortgage company file a lien release as required by the adversary order and discharge order. Follow up as necessary.

        - Allow 45 days following discharge for the mortgage company to file the lien release.

        - If time is of the essence, or if 45 days pass and no lien release is recorded, you can file the lien release yourself (at your own cost)

        1) Print a copy of the attached order and take it with you to the Clerk of Courts at the Bankruptcy Court , request a certified copy (take cash, there is a fee for the certification)

        2) Take your certified order to your county recorder’s office and file it as a lien release (take cash, there is a fee for recording)

            I think the procedure may vary by court or state. In my case, my attorney filed a motion for order removing lien. I thought I was going to have to record a certfied copy of the order, but I checked my county recorder's office and discovered that my lender recorded a release of lien after the order removing lien was filed. So, I didn't have to record the order and make the BK a permanent part of the chain of title to my home.
