I made a huge mistake, and forgot to send in half of my tax refund this year. I only have several months of payments left and just received a notice to file a motion for dismissal for failing to send in tax refund. I guess i have 21 days to object..I've had a lot going on recently and it just slipped my mind to send it in. unexcusable, I know.. of course it's a Sat and my attorneys office is closed so I can't do anything until Monday. Is this a case where I can just send it in now and the trustee will stop the proceedings to dismissed? I would just be devastated if they dismissed it when I am so darned close to finishing it! Anyone have this situation occur and you were able to just send it in LA? Thanks so much for any help or insight!

Bulldog77 yes you can send it in still! I would send it in and your attorney should file an objection to the Motion to Dismiss indicating that the tax return and the required 50% of the tax refund were turned over to the Trustee. They won't dismiss your case under those circumstances. The key is paying what is due and then notifying the Trustee to have them withdraw and/or the objection to the motion to dismiss.Chapter 7 (No Asset/Non-Consumer) Filed (Pro Se) 7/08 (converted from Chapter 13 - 2/10)
