    Surrendered my condo in '11 filing, CR shows 16 late payments until '13 foreclosure

    Hi All,

    I have 6 months left in my 5 year plan. I want to rebuild my credit in order to refinance my house after my chapter 13 falls off my credit (7 years after my filing 2011 date). I just now decided to check my 3 credit scores & see if there are any errors. As the title says, I surrendered the condo (a rental), with late payments being reported. Is this something I can dispute? I am very well aware that I'm still responsible for the post-filing HOA dues. My understanding is a late mortgage payment stays on your credit for 7 years.

    You can certainly dispute anything that you find is wrong. I would dispute the reporting as it should have stopped on the day of filing. I would file a dispute in writing both to the CRA(s) and to the lender. Hopefully, you can get the tradeline just totally deleted. It's okay to start cleaning up now.

        I disputed some mortgage lates in the same situation. 2 CRAs had already dropped the account but 1 still hasn't. I disputed and their response was that any lates prior to discharge could be reported. I gave up. It should fall off later this year anyway and I didn't want to poke the bear anymore.

          mynameainttracy, did you dispute online or snail mail? Did you need to send any documentation to back up your filing date for those 2 CRAs that dropped that account?

            You can refinance your house now ,while in ch13. It will save the 2 years that you have to wait after your discharge.

            FHA or use HARP. there may be others.

            We are doing a HARP refi now with 9 months left in ch 13 . GOOD LUCK

              Yes, late payments before filing will remain on your credit report. But, the last of those should drop off at the same time as the Chap 13.

              Filed Chap 13 April 2010. Discharged May 2015.
              $143,000 in debt discharged for $36,500, including attorneys fees. Money well spent!

                I disputed online and snail mail and provided my schedule of accounts that showed them listed as well as my discharge papers that showed my case number.. My 13 dropped off in April of 2015 but these two accounts, my first and second mortgages, still show up. We had been staying and paying for about a year before we decided to surrender and so my first DOFD was later than my 13 filing date. These accounts don't even show up on two of my credit reports but the one, Experian, just refuses to delete.

                We have been able to buy a house and 2 cars so I have just been living with it. They should fall off in Dec so at least I can see the light.
