Just received a letter from my lawyer saying: Please send $150 to cover the cost of removing second mortgage lein from your home: Second mortgage lein will remain on the public record until the order avaoiding has been recorded. It's Saturday, so I can't call him. Does this mean my second mortgage was stripped?

Chop I can't tell if the Order Stripping Lien was already entered (meaning that the Judge already signed the order). If your attorney already did your Motion to Strip and it has been a while since you've heard anything, then maybe the Judge signed the order already. Just not enough information from what you're saying.

It sounds to me like the order avoid your lien has been entered and your attorney is telling you how much it will cost to get a certified copy of the order from the court and have it recorded with the county recorder. $150 sounds about right for attorney fees and expenses to do that, but you can also do it yourself and save over $100 of that. You can go to the court to get a certified copy of the order or request one by mail. There will be a certification fee of $11 and a copy fee of 50 cents a page. Then you record the certified copy of the order with the county recorder. Again, there will be recording fee of probably less than $20. I suggest doing that in person to make sure you don't need to submit it with certain forms or a cover sheet.
I suggest waiting a bit and seeing if the creditor records a reconveyance. I got a certified copy of my order and was about to record it. I decided to check the county website to make sure the document number for the mortgage was correct on the order and noticed that Citibank had already recorded a reconveyance, making the recording of the order unnecessary. Now my bankruptcy won't be a permanent part of the title history of my home.LadyInTheRed is in the black!
