    Mortgage company reporting during active CH13?

    I am in a trial period to secure a modification while in a Ch13 and today I noticed the mortgage company has reported me as late. Is this allowed?
    11/23/'10-filed ch 13. 1/6/'11-341, confirmed. Below median. Plan completed 11/30/2015. DISSCHARGED 4/4/2016.JP

      Could it be that the post filing late payments can be reported?

        Yes its correct unfortunately, it's not right by any means but it's a fight you won't win, we've tried for years and are still trying to get it corrected. None of the credit reporting agencies will budge and neither will the mortgage co. The reason being is because you're paying partial payments under the trial. This still will not change if you're approved for permanent reduction after trial either, you will get a blurb put on your credit report from mortgage co stating you were in a trial then approved. At this point after perm. Approval it may report differently but that statement will remain until THEY decide to remove it.

        I've been fighting with the credit reporting agencies since our Ch. 13 discharge to correct things as well. Some things they did while others, regardless of proof we've provided to them they refuse and state we mist resolve directly with servicer. One of which is our mortgage companys statement regarding modified mortgage approval (it shouldn't be there at all, our mod was done 5+ years ago permanently and nowhere in HAMP does it say they can report with a statement), as well as saying they can report Ch 13 until 2021, and lastly not reporting Paid as Agreed Never late for the past 5 years. Mortgage was outside of plan but they refuse to report anything other than ND (no data) as well as refusing to report as Positive until 2016, one year after our discharge when our mortgage came out of their damn Loss MIT dept and should be reporting normally effective date of discharge.

            I spoke to attorney's office and I was told that they can report anything, but that once the modification is in place and we are discharged they will edit the reporting.

            I do hope she was correct as it was a 100 point swing on the credit.
